For California workers' comp billing, the only DMEPOS that require an invoice for proof of purchase are those that qualify as a dangerous device.
The definition of dangerous device is set forth in California Business and Professions Code Section 4022:
The DME Fee Schedule allows a payer to request documented paid costs when reimbursing for dangerous devices as referenced in statute 5307.1.
Per Statute 5307.1 reimbursement for dangerous devices shall not exceed either:
- The amount allowed per the fee schedule; or
- 120% of the documented paid cost, not to exceed more than 100 percent of the documented paid plus $250.
